Hi! I’m experienced US trademark attorney Morris Turek. I live and practice law in St. Louis, Missouri, but I work with individuals, businesses, and organizations located throughout the world that want to protect their trademarks and avoid the high costs and devastating effects of being sued for trademark infringement. Regardless of where you’re located, I can help perform your US trademark search, prepare your trademark application, guide you through the trademark registration process, respond to a trademark office action, represent you in trademark opposition and trademark cancellation proceedings, and provide you with valuable legal advice in a wide variety of trademark and other intellectual property matters.
5 Reasons To Choose Morris for Help with Trademark Registration and Litigation
My primary goal as a trademark attorney is to save you time, money, and aggravation by helping you navigate the complexities of trademark registration and trademark litigation by using the knowledge and experience I’ve gained over many years of practicing trademark law. I realize that you have dozens of options when it comes to choosing a trademark lawyer, but here are five reasons why you may want to consider working with me:
Reason #1 – Experience Matters
I’m a U.S. licensed attorney who has been practicing trademark law since graduating from St. Louis University School of Law in 2005. In my career, I’ve performed at least 2,500 comprehensive federal trademark searches, filed over 3,500 trademark applications with the United States Patent and Trademark Office (USPTO), been involved in dozens of Trademark Trial and Appeal Board (TTAB) proceedings, and have assisted thousands of clients located in many different countries with nearly every type of trademark matter. I’ve seen it all and I’ll use my vast experience to help accomplish your specific objectives in the most efficient and cost-effective manner possible. And if I know that I’ll be unable to achieve what you want, I’ll tell you that upfront before you spend even one dollar with my law firm.
Reason #2 – It’s Free to Talk to Me
I think it’s essential to have a telephone conversation, an in-person meeting (if you live in the St. Louis metropolitan area), or at least a back-and-forth email exchange so that we can both learn more about each other and figure out whether we make a good team to reach your goals. Unlike many of my competitors, you can’t hire me by filling out an impersonal, one-size-fits-all template questionnaire and submitting your credit card information. I don’t practice law like that because operating in such a manner would do a great disservice to the both of us. And because our initial consultation is completely free-of-charge with no obligation whatsoever, what do you have to lose?
Reason #3 – We’re a Team
If you want personalized advice and guidance concerning your specific trademark matter, and are uncomfortable handing out your credit card information to someone you’ve never met, spoken to, or even exchanged emails with, then I’m confident you and I will be a good fit. It’s my duty as an experienced trademark attorney to give you all the time and attention you need to make informed decisions. All I ask is that you invest a little time with me because your involvement is crucial to the success and prosperity of your particular venture. And I promise to do everything I can to earn and keep your business so that we may continue working together for many years to come.
Reason #4 – 100% US Trademark Attorney Service
If you expect to have your trademark search and trademark application completed by a skilled US trademark attorney and not a paralegal or legal secretary, then you’ve come to the right place. At many law firms, the role of the trademark attorney is essentially limited to “signing off” on work done by various non-attorneys. Not at my trademark law firm. I assure you that 100% of your legal work will be performed by a U.S. licensed trademark attorney. And when you call my law firm, you’ll always speak to me personally about your trademark matters and not a receptionist, secretary, or paralegal.
Reason #5 – No-Surprise Flat-Fees
If you’re seeking an affordable trademark attorney who offers straightforward flat-fees for almost all trademark services (including federal trademark search and federal trademark registration), and who aims to provide the best possible value for your hard-earned dollar, then I hope you’ll consider contacting me. Although my services may be a bit more than those offered by the many discount trademark law firms you’ll find advertising all over the Internet, if overall value and satisfaction is key in determining which trademark attorney to hire, you won’t be disappointed with my firm.
Is it a Good Idea to File a Trademark Application on My Own?
Thousands of people file their own trademark applications each year. Most of these prospective trademark owners are in the beginning stages of launching a new venture and are understandably concerned about staying within their budgets and making sure they have money for all of the other important things they need. But if you’re like most people, you might not have enough information to make an informed decision as to whether filing your own trademark application is in your best interest. So, here are three potential issues to think about:
Issue #1 – What If I Make a Mistake?
The USPTO trademark application form is not as straightforward and simple as it might initially seem. It’s very easy to make inadvertent errors and not even know about them until you receive a trademark office action from a trademark examining attorney. Although some mistakes are able to be corrected after your application is filed, many are not. If your trademark application contains an error that cannot be fixed, you’ll have wasted the filing fee that you paid to the USPTO. Your only choice will be to file a brand new application and pay another government filing fee. More importantly, you will lose your federal priority filing date, which can be disastrous if someone else happens to file an application for a confusingly similar trademark before you can submit a new application.
Issue #2 – Rejections and Delays
A trademark application filed by an experienced trademark lawyer is much more likely to (1) be approved by the United States Patent and Trademark Office, and (2) not challenged by other parties. This is because your application will be complete and accurate. Trademark attorneys know exactly which questions to ask you to obtain all the information they need to ensure that your trademark application is properly prepared and timely filed. Avoiding unnecessary rejections and delays (not to mention trademark oppositions) during the trademark application process is the key to keeping trademark registration costs as low as possible.
Issue #3 – Meeting Important Deadlines
There are important deadlines that will need to be met after your trademark application is submitted to the Trademark Office. Unlike a U.S. licensed attorney with a long track record of successfully registering trademarks, you may be completely unaware of such deadlines. Missing these deadlines will result in your trademark application going abandoned.
Using an Online Trademark Service vs. Hiring a Trademark Attorney
OK, you’ve decided that you don’t want to go through the US trademark application process by yourself because you want to minimize the risk of your trademark application being rejected after it’s reviewed by a trademark examining attorney at the USPTO. So, what options do you have for seeking trademark protection for your valuable name, logo, or slogan?
Option #1 – Use a Trademark Filing Company
A quick Internet search uncovers plenty of trademark filing companies claiming to be “the best trademark company” or “the best trademark filing service” or “the best trademark registration service.” As a trademark registration lawyer, I find these claims laughable because none of these trademark filing services provide any real service at all. These are do-it-yourself trademark filing companies. What they offer isn’t much different than what’s offered by the United States Patent and Trademark Office on its own website. In other words, filing a trademark application through one of these companies is essentially the same as filing a trademark application yourself through the official TEAS system. In addition, these companies will be nowhere to be found after your application is filed. The minute after they click “submit” on your application, you’ll be pretty much on your own. It will be you against the USPTO trademark attorney in charge of examining your application. That’s not somewhere you want to be if you’ve already determined that navigating the trademark registration process alone isn’t for you.
Option #2 – Hire a Cheap Trademark Lawyer
Another quick Internet search reveals dozens of cheap trademark attorneys competing for your business. For example, they might offer to perform a comprehensive trademark search for a very low price. But that comprehensive search often comes with no legal advice or professional opinion as to whether you’ll successfully achieve a registered trademark. Or, these cheap trademark registration attorneys might offer to file a trademark application for a fee that seems almost too good to be true. Well, that’s because you won’t receive a thorough explanation of the trademark process and it will probably be difficult to reach them personally once they have your money and file your application. Plus, what will be the chances of them being available if something unexpected happens during the trademark registration process (such as a trademark opposition)? Will they be responsive if you have important questions or concerns about trademark protection that need to be addressed? Will you be able to go to them if your registered trademark is later challenged? How much experience do they even have filing trademark applications with the Trademark Office? We all know that in life we generally get what we pay for. Trademark lawyer services are no exception.
Option #3 – Work with a Trusted, Experienced, and Affordable Trademark Lawyer
Thankfully, not all trademark lawyers are just trying to be the cheapest. There are lots of fantastic intellectual property attorneys all over the United States who would never operate or practice law in a way that would leave you wishing you had just tried to do everything yourself.
Every day, I strive to be the best trademark attorney I can for my clients. In order for me to do that, I must appropriately price my trademark services such that I can give you the time and attention you need to accomplish your goals. This allows me to be an affordable trademark attorney who can focus on providing extraordinary value that far exceeds the money you’ll invest in registering a trademark or in any other trademark matter you might have.
Look, I haven’t stayed in business for over 15 years by making empty promises to clients and encouraging them to spend money on things like filing trademark applications that are doomed to fail or pursuing trademark oppositions that have little chance of success. I never make outlandish guarantees and I don’t make deceptive claims about my services and the fees associated with them. If you read some of the hundreds of reviews, testimonials, recommendations, and endorsements clients have posted on the Internet about their experience working with me, you’ll see that they were not only pleased with the result, but also my clear and candid communication with them throughout the entire representation. I’ll do exactly the same for you.
I’m Ready for Option #3!
If you dislike the idea of paying trademark fees to do-it-yourself companies such as Trademark Engine, LegalZoom, Trademarkia, and others for the “privilege” of doing all of the work yourself, or have serious doubts about hiring one of those cheap trademark lawyers to file a trademark application, then I encourage you to contact me instead. I’ll show you why choosing to work with a detail-oriented US trademark attorney who performs all work from start-to-finish in a prompt and efficient manner is frequently the best option for aspiring trademark owners.
